FACILITY PROVIDER CONTRACT - CLAY 2009 SEASON
As a facility provider, we agree to the following:
1) Facility will designate an adult Facility Representative, who will be present at all games, or who will designate another adult as his/her designee when not able to be present. The Facility Representative is responsible for the presentation, maintenance, safety and security of the Facility within the confines of Facility policy. CLAY bears no responsibility for the actions of players or coaches. Right Choice Today, Inc. and CLAY management, as well as local chapter officers visiting Facility will defer to the Facility Representative on all matters regarding the facility. In the event of a game day emergency, all league leaders in attendance should work together for the safety of players, coaches and fans. Facility Representatives will be mindful Referees are in charge of the game, and thus are the ultimate authority of players and coaches during the game. CLAY grants Referees and Facility Providers the right to remove fans who engage in threatening or offensive behavior, including the use of profanity and derogative remarks.
2) Compensation is $25 per scheduled game. Facilities are paid at the conclusion of the post season. Facilities who also sponsor teams are expected to pay for their teams at the beginning of the season, as required for team sponsors who are not able to provide game day facilities.
3) While schedules are posted at the beginning of the season, they are subject to change. Should a schedule change occur, the Facility will be compensated for non-games if the change is not communicated to the Facility Representative at least 24 hours before game time. Notification will be via email. A sent email is considered notification.
4) Facility shall provide a scorekeeper, who will use CLAY Score Forms. It is the Facility Provider's responsibility to submit scores as described on the CLAY Score Forms within 48 hours of the final game each week. If the Facility wishes to compensate the scorekeeper, it is up to the Facility. CLAY will issue payment only to the Facility.
5) Facility shall provide game balls as follows: 27" junior "small" ball (only if hosting "Fun" Division games); 28.5" ball (for all Girls' games and Boys Developmental Division games; and standard full size ball (for Boys Competition Division games). Balls must be of good quality, and be standard coloring. Different colored or multi-colored balls, even if of acceptable quality, are not permitted. Facility is NOT responsible for providing practice balls to visiting teams.
6) Facilities hosting "Fun" Division games must have two portable, adjustable hoops, which shall be lowered to approximately seven (7) feet in height (typical lowest setting). Portable hoops must be anchored in place in such a manner as not to create a safety issue (bases filled with sand or water, or sand bag tubes covering the base are acceptable).
7) Facilities must have seating accomodations for fans. Standing courtside is not acceptable, nor permitted.
8) Facilities are encouraged to offer concessions. CLAY will not set, nor recommend, menus nor prices; however, CLAY does request prices be reasonable, especially for water and other drinks players may use to keep hydrated during or after the game. If proceeds from concessions are designated towards a mission project, service group, facility improvement, etc., CLAY suggests posting a sign to that affect.
9) Facilities shall carry proper liability insurance, and provide a certificate of insurance to CLAY upon request. Team Sponsors are required to carry insurance covering their players. All players are required to sign waivers indemnifying Facilities, among others, and should an incident occur requiring the Facility to have a copy of that waiver on file, a request should be made in writing, via email to Tony Craig, President; Right Choice Today, Inc. at tony.craig@rightchoicetoday.com.
10) All injuries must be reported to Tony Craig, President; Right Choice Today, Inc. at tony.craig@rightchoicetoday.com and the Erie Chapter Commissioner at clayerie@rightchoicetoday.com.
